An adequacy decision is a binding mechanism in EU data protection law, which allows the European Commission to determine whether a non-EU country or an international organisation offers an adequate level of data protection. The effect of such a decision is that personal data covered by the decision can freely flow from the EU to that non-EU country or international organisation.
The EDPB issues opinions on draft adequacy decisions, assessing if data protection standards are met. These opinions offer valuable input to the European Commission, which ultimately adopts the adequacy decision.
