Electronic evidence, or 'e-evidence', refers to digital data used in the investigation and prosecution of criminal offences. This includes, for example, emails, text messages or content from messaging apps, audiovisual content, and information about a user's online account.
As this type of data often contains sensitive data, safeguards are required to prevent misuse and protect the rights of individuals. The EDPB issues guidance to ensure that the processing of e-evidence respects data protection principles and safeguards personal data.
